On July 27, 2009 the Federal Bureau of Investigation (FBI) incarcerated seven men for conspiracy to commit terrorism in Raleigh, North Carolina. The shocking case was dubbed “the Raleigh Jihad” or “Terror Triangle” plots. The government’s salmagundi narrative was that at an unspecified time and date, with unknown weapons and obscure methods, these North Carolinian Muslim Americans who were gullibly brainwashed by an idiosyncratic ring leader, Daniel Boyd, would suddenly engage a design of monumental proportions which in Don Quixote tittup, would put a Rambo sequel to undeniable shame.

The FBI, in a strange theatrical version of the movie the Minority Report, claimed the accuseds’ thoughts, derived from voice recordings and witness testimonies and Facebook posts, were evidence that they intended to simultaneously attack the heavily fortified Marine Corps base in Quantico in Virginia, ignite a jihad war in Kosovo and Iraq (Iraq already a location of insurgency), and bomb unidentified targets in Israel. The prosecuting attorney, Jason Kellhoffer, former defense attorney for Calvin Hill in the controversial case of the murder of Airman Ashley Turner at a U.S. Air force base in Iceland, employed NBC terrorism quack, Evan Kohlman, to convince a naive non-Muslim jury that the defendants had the “radical ideology” akin to violent terrorists in the Middle East. Kohlman is the same figure that reputable Central Intelligence Agency employees, Marc Sageman and Philip Giraldi, have summarily described as fraudulent.

Convictions such as Yaghi, and possibly the Duka brothers in the Fort Dix 5, the Newburgh 4, Yasmin Cassim’s father in the United Kingdom, and more may also be textbook examples of an affront to Due Process and Rule of Law wherein these Muslims, as with Yaghi, have been prosecuted for akin actions and statements that I have witnessed many times over, by some white Anglo-Saxon protestants extremists often.  The subtle difference is these Muslims may have made comments opposing U.S. Foreign policy in such places as Israel and so on. So much for Clarrence Darrow’s wisdom, “True patriotism hates injustice in its own land more than anywhere else.”

Human Rights Watch (HRW) in its publication titled “Illusion of Justice,” underscored that the prosecutor Mr. Kellhoffer strangely asserted terms employed by Yaghi in his email communication with Boyd in 2006, while the former was in Jordan and latter in America, such as marriage, beach, and pizza; were covert code for terrorism. HRW added that FBI agent Robert Powell admitted that there was no substantial evidence to prove Yaghi traveled to the Hashemite Kingdom of Jordan for terrorism in 2006. Finally, HRW concluded that Yaghi’s conviction, including the other six defendants, was a clear violation of not only the United States Constitution, but international human rights laws.

After perusing the teeming pages of court transcripts which would be comparable to Herodotus’ Histories, a purveying sense of terror struck my nerve cords. That sense of fear didn’t derive from reading the maniacal thoughts similar to Al Qaeda and the Islamic State within the documents. Instead, I concluded one defendant, Ziyad Yaghi, was convicted diametric to English Common Law and William Blackstone’s advice, “it is better to let ten guilty persons escape than that one innocent may suffer.”

I sincerely conceive that the Ziyad Yaghi’s conviction has no possible merit whatsoever with exemption to a world of Agatha Christie and Harry Potter imagination. In this lifetime, I’ve determined Montesquieu was absolutely right, “there is no crueler tyranny than that which is perpetuated under the shield of law and in the name of justice.” Ziyad Yaghi’s tragedy is a microcosm of such sad yet sagacious dictum.

New Evidence Ignored in Case of Ziyad Yaghi: (Audio-Video-Affidavits)

The following investigation and report, I concluded on behalf of the Constitutional Law Center for Muslims in America (CLCMA) and Attorney and former U.S. Navy Lieutenant Commander Charles Swift (https://en.wikipedia.org/wiki/Charles_Swift). It regards new evidence from an on the ground investigation which was initially omitted and not introduced into a United States trial case for the defendant, Ziyad Yaghi.

The new evidence presented in this report highlights the Western mainstream media’s bias toward upholding the War of Terrorism scare narrative and their lack of passion toward true journalism; via not thoroughly investigating such facts as contained within this report, nor making such revelations public to the audience. It also seriously questions the respect by the Federal Bureau of Investigation and US Attorney’s Office for the Rule of Law, Due Process, and US Constitutional and human rights of dissidents in America. The FBI, Jason Kellhoffer, the Western media, and the defense attorney for Yaghi; all failed to investigate and avoided easily accessible evidence, which refuted allegations against Yaghi.

The peculiar case of the farcical conviction of Ziyad Yaghi in 2011, for unspecified terrorism, has monumental and gossamer flaws evident to the perspicacious. The federal government claimed Yaghi traveled to Amman Jordan in 2006, in order to commit terrorism in Israel/Palestine, but arrested him in 2009. The obvious yet most curious query is why didn’t the authorities detain Yaghi in 2006 when he returned to the United States from Jordan, in the first place?

The answer to the aforementioned query is, that Yaghi was arrested in 2009 instead of 2006, because the entire terrorism narrative against him was concocted by the the prosecutor Jason Kellhoffer, in 2009 alone.

Precursory Research

Next, I eclectically researched online publications of all political spectrums. The mainstream media employed melodramatic rhetoric aimed to demonize, nearly all solely regurgitated the government verbatim. There were exceptions. NBC News quoted a shocked neighbor of Daniel Boyd, “if he’s a terrorist, he’s the nicest terrorist I ever met in my life.” There were others that explored the transcript’s labyrinth and courageously opined. Blogger Maureen Claire Murphy accentuated her doubt upon Yaghi’s conviction appending in the title of her publication the phrase, “sleeping jury.” https://electronicintifada.net/blogs/maureen-clare-murphy/decades-long-sentences-young-us-muslims-convicted-vague-terrorism She additionally highlighted that within 700 hours of discreet FBI recordings via criminal informants, Yaghi wasn’t in any of them.

Murphy also emphasized that the Megatron of these deceptive and evil terrorists, Daniel Boyd, even testified in court, Yaghi had no knowledge upon any terrorist plot. Jewish American author, Stephen Lendman, titled his publication in disbelief, “Ziyad Yaghi – Guilty of Being Muslim in America.” http://rense.com/general95/zi.html Lendmen emphasized of the trial that the, “government paid bogus experts [sic] lie…Credible defense witnesses were ruled out of order and denied.” Another NGO named Project Salam staunchly defended Ziyad’s innocence even going to the length of reporting via statistics that 74% of prosecutions including Ziyad’s, for Terrorism charges, have been based upon thought crimes as opposed to actions.

According to history,  I am quite familiar that during war, the United States has an irrefutable record, at least since John Adam’s  Sedition and Alien acts, for occasionally impinging upon the sacred Bill of Rights of our citizens combined with vigilantes mercilessly meting punishment upon groups of ‘alien’ immigrants in an emetic xenophobia. Today is only a slight improvement from Roosevelt’s 1942 Executive Order 9066. In consequence of the preceding, I navigated the trajectory others apathetically failed to perform. A path even the prosecutor, Jason Kellhoffer and Ziyad Yaghi’s defense attorney Jim Ayers, didn’t accomplish.  I thoroughly investigated this peculiar case myself, in Amman, Jordan.

The prosecution’s accusation depended heavily upon the premise that Ziyad Yaghi journeyed to Jordan in 2006, pursuing jihad by taking Daniel Boyd’s advice of seeking ‘good brothers’ at Shishani Mosque, which according to Kellhoffer, was code for terrorists.

Interviews

I commenced by interviewing Ziyad’s cousin, Khaled Shibley Yaghi, with a Cape Academy interpreter named Sawsan. Khaled was extremely jovial and possessed a sense of humor. I was comfortable with Ziyad’s entire family to add. When mentioning Ziyad’s conviction, disbelief and palpable sadness filled the atmosphere from an elderly gentleman who spent a lot of time with a young Ziyad when the latter visited his family in 2006.

Khaled expressed religion and politics were not primary topics Ziyad ever discussed during his stay. According to Khaled, Ziyad was more interested in embracing and learning about his Jordanian and Palestinian/Israeli heritage. Khaled finally stated neither Yaghi’s defense attorney Jim Ayers nor the prosecution ever questioned or visited him. Also included is Mawfiq Shelley Yaghi’s affidavit.

My colleague Miles Shelly, an instructor from Berlitz Language Institute, interviewed an uncle of Ziyad named Ali Yaghi, who Ziyad resided with during his entire stay. Ali indicated via private phone calls with me and a recorded interview with Miles, that he accepted the position of conduit between a potential bride and Ziyad.

According to Ali, Ziyad was predominantly focused on marrying while in Jordan. Additionally, Ziyad was very concerned for Ali’s mother who was very sick. Ali’s mother passed away approximately six months after Ziyad’s return to the United States. When asked about whether Ziyad made any contact with Daniel Boyd while in Jordan, in order to plan jihad in Israel as the prosecution’s claim, Ali replied in a stern confident negative. In disbelief, Ali admitted that he never heard of Mr. Boyd until Ziyad’s arrest. He also admitted neither Ziyad’s defense nor the prosecution, attempted to contact him.

I and a former colleague, Jamal Albes, then performed an interview with another of Ziyad’s uncles, Ahmed Yaghi. Ziyad spent a lot of time with the younger Ahmed in consequence to the nearness of their ages. Ahmed asserted that Ziyad predominantly exerted efforts with Ahmed on achieving the legal and cultural steps toward marriage in Jordan. Ahmed laughed when queried upon Ziyad’s extremist thoughts replying, while smiling, that Ziyad once created an anti-smoking campaign on YouTube.

Ahmed reflected on the moments Ziyad and him picked olives in the family’s garden, prayed at the local mosque,  joined a kickboxing club, and Ahmed especially recollected the memorable moments of teaching Ziyad Arabic, since the latter had no knowledge of the language. Ahmed finally affirmed neither Ziyad’s defense nor the prosecution contacted him.

Neighbors, close friends, and family of Ziyad Yaghi in Jordan testified in consensus that Ziyad possessed no possible time for experimenting with implementing jihad nor did he express any red flags of such religious extremist mindset. Additionally, Ziyad did not even possess a working knowledge of Arabic to potentially buddy up with Arab terrorists. He was an outsider trying to fit in and at worst, sought attention in eccentric humorous ways.

Everyone also asserted that he was completely occupied with marriage while in Jordan. Many personal Jordanian friends of mine that I confided in expressed disbelief at such narrative entailing Yaghi’s conviction.  Finally, Yaghi’s conviction for attempting to travel to Jordan to engage in Jihad in 2006 resulted without the prosecution or defense contacting the pertinent and credible witnesses I interviewed above.

Shishani (Chechen) Mosque

Next, I visited Shishani Mosque in Zarqa, Jordan. Shishani in Arabic means Chechen. Kellhoffer averred that Daniel Boyd discreetly instructed Ziyad by e-mail and via the code word ‘good brothers,’ to meet Islamic terrorists at this location.  I spent many of the six years of residence in Jordan occasionally visiting and praying at the Mosque, while simultaneously befriending long time residents in the community.

Emad Abu-Bandoura, 20 year resident and Chairman of the Board of Zarqa Commerce, akin to the majority of other residents’ opinions, expressed complete disbelief at the incredulous proposition that Ziyad visited the mosque to rendezvous with terrorists. Emad went further stating that in the history of Shishani mosque, there have been no known terrorists who attended the mosque nor terrorist incidents nearby. Finally, no one at the mosque recognized Ziyad’s picture.

I also personally felt Shishani mosque a very unlikely place of congregation for Islamic terrorists. Its geographical position is an existing refutation of such preceding hypothesis. At the end of its street, approximately 30 feet from the mosque, is a guarded police station.  Directly across, about 10 feet, is a municipal government building. A few blocks away, is a Jordanian Intelligence office.  More importantly, the Jordanian intelligence consistently and discreetly supervises khutbas (sermons) at the mosque to deter such radical miscreants from intermingling with regular attendees.

Jordanian Intelligence and National Centre for Human Rights

My next destination was the National Centre for Human Rights near the third circle in Amman. I spoke to Atef Majali, human rights investigator. Mr. Majali informed me that the centre could not assist because the topic pertained to the National Security affairs of America. I couldn’t alter his attitude despite emphasizing Ziyad’s activities in Jordan  in 2006 were the primary evidence for Ziyad’s conviction in a United States Federal court. I departed with the impression Mr. Majali was fearful of getting involved.

My final destination was the office of the Jordanian Intelligence (GID). Former students in the GID of mine, though continuously expressing disbelief in Ziyad’s conviction, were unwilling out of fear to aid me. Yet one suggested I pen a letter to the King of Jordan.  As he asserted,”nothing happens in Jordan without the King’s knowledge or permission.” A sincere appeal to the King’s office was never answered though. Nevertheless, I then traversed the bustling Amman traffic to visit the Jordanian intelligence office in order to request any records relevant to Ziyad Yaghi’s case. I arranged an appointment to return.

My initial excitement inevitably transformed into unexpected shock and anger toward an act of perfidy. A few weeks later, I was quickly arrested by eight armed men at my apartment, detained for a week without access to a phone, and finally deported with ominous verbal instructions to never return. I confirmed with my own eyes that the deportation order was signed by the GID.

No reason was given but I feel this and other investigations pertaining to refugee abuse and neglect, corruption in the Ministry of Education, and Jordan’s complicity with terrorist entities was the derivative without doubt. Some say I deserved what occurred to me, I say in the name of humanity, I would do it again!

Conclusion

The evidence I collected above was introduced by the CLCMA to the U.S. Supreme Court for Yaghi’s retrial. The highest court in America denied Yaghi a retrial on the grounds of protecting ‘National Security.’ It is my assumption, and why, I can’t and won’t reveal, that the Jordanian Intelligence gave ‘bad’ intel on Yaghi. Any dilettante on the GID knows how politically and financially motivated their ‘intel’ has become under a profitable War of Terrorism. Also, I have the assumption that Yaghi and others were imprisoned for having prior criminal records and simultaneously being Muslim, so as to avoid security risks in exchange for their constitutional and human rights by the upper echelons of the US government.

I pray history will bear witness to this dismal injustice within her pages for our posterity, more importantly, for humanity. Highlighting the injustice to Ziyad and his poor family would interpret into America is fallible, which I find benign. Pointing out such injustice would also interpret into our government violates our sacred Bill of Rights during conflict, which history reveals isn’t original or unfamiliar.

However, appending Ziyad Yaghi’s case to history’s pages may allow America may to be a gleaming example of how even great nations make mistakes, so that others may be more willing to admit and correct similar injustice. This is the other, or next instrument, against the cruel obstinacy and dangerous hubris of the law, which sometimes is the unfortunate antithesis of a higher principal of justice. This is also the next powerless step in never ceasing to protest injustice, as American Jewish writer Elie Wiesel asserted we humans must strive to continue to do always.

Until then, an innocent Ziyad Yaghi will be nearer to finishing his thirty year solitary confinement in a federal penitentiary, for a thought crime he perhaps never contemplated, and undeniably, never even committed.
